CHAIDE SMART Privacy Policy
These terms of use (hereinafter, "Terms") regulate the contractual relationship between the user (hereinafter, "User") and CHAIDE Y CHAIDE S.A. (hereinafter, "CHAIDE"), which includes access or use that the User makes, as a natural person, from any place in the Republic of Ecuador of the mobile application (hereinafter, "Application" or "CHAIDE SMART"), which includes content and services (hereinafter, "Services" or "Service") detailed in this document and made available to them by CHAIDE. Users will be subject to all policies and other principles that govern CHAIDE and are incorporated herein by reference.
CHAIDE Y CHAIDE SA places great importance on the protection of your personal information and privacy. We will provide corresponding security measures for your personal information in accordance with legal requirements and industry-standard security practices. "You" and "User" refer to all individuals and entities who obtain CHAIDE SMART Services.
• We will use your "CHAIDE SMART" account information to obtain access to the "CHAIDE SMART" application server. If you do not provide your "CHAIDE SMART" account information, you will not be able to use certain services provided by "CHAIDE SMART."
• We collect your personal data to provide basic services for smart device management, user scenarios, and feedback functions, as described in detail in the main text.
• In collaboration with our ecosystem partners, we provide device-sharing functionality. Your device information will be shared with these partners to deliver better services.
1 How We Collect and Use Your Personal Information
1.1 Account Login
When you use "CHAIDE SMART" Services or manage smart devices, we need to collect the following information: your "CHAIDE SMART" account username, login password, nickname, and avatar. Among these, the username and password are considered sensitive personal information. The purpose of collecting this information is to authenticate your identity on the "CHAIDE SMART" account server and grant access to the "CHAIDE SMART" application server.
We will use your personal information as follows: The "CHAIDE SMART" account username and login password you enter will be encrypted and transmitted to the "CHAIDE SMART" account server for login authentication. The application and server will not store the information you input. When you use a third-party account to access CHAIDE Y CHAIDE SA's services, we will use the Open ID of that account to bind it with your device ID. Additionally, we will obtain registration information such as your phone number and email address from the third-party account.
If you do not provide this information or fail to log in to your "CHAIDE SMART" account, you will not be able to use "CHAIDE SMART" services. After logging in, the "CHAIDE SMART" application will automatically retrieve your account nickname and avatar and display them on the application interface.
1.2 Basic Smart Device Management Services
To discover smart devices and connect to WLAN networks, the "CHAIDE SMART" application requires access to your phone's location permissions to obtain the WLAN list, as well as the WLAN name and password you input. The WLAN password is considered sensitive personal information. This information is used locally and will not be uploaded to the server.
For your convenience in binding devices, you can enable the "Remember Password" feature in the "CHAIDE SMART" application. The WLAN password will be encrypted and stored locally in the "CHAIDE SMART" application for future device binding, eliminating the need to re-enter the password. However, if you choose not to enable this feature, it will not affect the device binding functionality.
If you use a router that supports automatic retrieval of the WLAN name and password, these details will be auto-filled for device binding.
The following types of devices are included in the data collection:
Lighting devices, including various lamps, mood lights, aromatherapy lamps, music lamps, etc.
Health devices, including sleep detection mats, detection pillows, detectors, etc.
1.3 Smart Device Cloud Services
To enable the use of your bound smart devices in the "CHAIDE SMART" application and provide related service functionalities, we need to collect the following information:
Custom avatar, nickname, age, gender, date of birth, and personal health data (heart rate, respiratory rate, body movement). Personal health data is considered sensitive personal information. The purpose of collecting this information is to monitor the working status of sleep detection devices, view detection data, and analyze historical statistics.
CHAIDE Y CHAIDE SA will only upload sensitive personal information such as health data to the server after obtaining your explicit authorization in the application. Please carefully read and authorize consent when accessing the device for the first time.
You can unbind or delete your smart devices by navigating to "Settings" > "Delete Device" / "Unbind Device" to stop data collection.
If you do not provide this information, you will not be able to use the services provided by smart devices in the "CHAIDE SMART" application.
1.4 Scenarios and Device Sharing
To enable scenario and device sharing, we need to collect the following information: user-defined scenario settings, "CHAIDE SMART" account, nickname, and shared device information for setting up scenarios, sharing devices, and receiving shared devices.
If you do not provide this information, you will not be able to use the scenario and device sharing functionalities.
1.5 Push Notifications
The integrated JPush (cn.jiguang) self-start service is used to improve the delivery rate of push notifications.
Purpose:
To promptly receive messages sent by application friends.
To improve the delivery rate of notifications, such as sleep reminders set by users.
Method: [JPush SDK] requires the collection and use of your [device information: device identifiers (IMEI, IDFA, Android ID, MAC, OAID, IMSI, etc.), application information (crash logs, notification settings, software list, etc.), device parameters and system information (device type, model, operating system, and hardware-related information), network information: IP address, WiFi details, base station information, etc.]. For specifics, please carefully review the "JPush Privacy Policy" at https://www.jiguang.cn/license/privacy. This feature requires your authorization to activate. You may navigate to "Me" > "Settings" and disable "Notifications" to turn off this feature.
1.6 User Experience Improvement
To troubleshoot issues and improve user experience, we need to collect the following information:
Logs from the "CHAIDE SMART" application and smart devices, including anonymized application basics, device basics, operational logs, exceptions, error reports, etc. Sensitive information will not be recorded in these logs.
We will use your personal information as follows: Users upload logs of "CHAIDE SMART" application operations and smart devices to the server for analysis to diagnose device status and identify or locate faults.
If you do not provide this information, faults in "CHAIDE SMART" services may not be promptly detected or resolved, hindering user experience improvements. However, this will not affect the basic functionality of the service. You may choose not to upload logs.
2 Device Permission Requests
Internet Permission: Required for privacy notifications and "CHAIDE SMART" login services. Authorization is requested upon application launch.
Local Network Permission: Required for registering smart devices on the local network. Authorization is requested during first use.
Location Permission: Required for devices to report accurate time and for statistical analysis of product distribution to improve user experience. Some smart device management pages require access to your current WLAN name. Authorization is requested during first use.
Camera Permission: Required for taking photos to update your profile picture. You may revoke this permission in your device's privacy settings.
In addition to the above, this application requires Bluetooth to be enabled for connecting Bluetooth devices. You may disable Bluetooth via system "Settings."
You may manage the application's permissions via system "Settings" at any time.
3 Protection of Minors
If you are a child (under 14 years of age), your parent or guardian must consent to your use of this application and its terms. Parents or guardians should also take appropriate measures to supervise minors' use of this application.
4 Third-Party SDKs
Some services are provided jointly by us and our partners, who have integrated our Software Development Kit (referred to as "SDK") or similar applications.
5 Managing Your Data
To facilitate your access, correction, and deletion of personal information during your use of CHAIDE SMART services, as well as to ensure your right to withdraw consent for the use of your personal information, we have provided corresponding operational settings in the product design. You may refer to the following guidelines:
(1) Accessing Personal Information
You can view the operational status and historical records of your bound smart devices on the device homepage and check device information (including device name, location, manufacturer name, MAC address, serial number, and network information) in the "Settings" page of the device.
You can go to "My" > "My Sharing" to view device sharing information, visit the scenarios page to check scenario settings, or click your account avatar to jump to the account information page.
(2) Deleting Personal Information
You can go to the device's "Settings" > "Delete Device"/"Unbind Device" to remove bound devices and clear device information stored locally and on the server.
You may uninstall the CHAIDE SMART app or clear app data to delete locally stored information. Alternatively, in the CHAIDE SMART app, go to "My" > "Account" > "Delete Account" to remove personal information stored locally and on the servers.
(3) Updating Personal Information
You can adjust device operational parameters and modify device information on the homepage of your bound device or in the device's "Settings" page.
You can update device sharing information in the "Device Sharing" section or modify scenario settings on the scenario setup page.
6 Data Storage Location and Retention Period
The above information will be transmitted and stored on CHAIDE SMART servers within the Republic of Ecuador.
We retain your personal information only for the duration necessary to fulfill the purposes stated in this policy and will delete or anonymize it afterward unless otherwise required by laws and regulations.
For CHAIDE SMART services, the retention periods are as follows:
Data stored locally in the CHAIDE SMART app will be deleted immediately upon app uninstallation or data clearance.
Server-stored device and business data will be deleted immediately when you remove a device in CHAIDE SMART or go to "My" > "Settings" > "About," click "Reject Terms of Service," and discontinue using CHAIDE SMART services
Server-stored business logs, statistics, and historical records are deleted during periodic server cleanups. If you use CHAIDE SMART, we retain your account information as mentioned in this policy to ensure normal service operation. Upon account deletion, all associated data, files, and backups are permanently erased.
Additionally, if our product or service ceases operation, we will notify you via push notifications or announcements and delete or anonymize your personal information within a reasonable timeframe.
8 Disclaimer
8.1 Third-Party Services
CHAIDE SMART services may include links or references to third-party websites. We do not monitor or investigate such websites and assume no responsibility for their content, functionality, or practices. The inclusion of links does not imply endorsement or guarantee by CHAIDE SMART. Accessing third-party sites is at your own risk. CHAIDE SMART recommends reviewing their terms and privacy policies (if available). You agree that CHAIDE SMART bears no liability for damages or losses arising from third-party site usage.
8.2 Precautions
Provided via CHAIDE SMART services is for informational purposes only and does not replace professional medical advice. We are not licensed healthcare providers and lack expertise in diagnosing, treating, or assessing the impact of exercises on medical conditions. Consult a doctor before starting any health regimen, dietary change, or activity mentioned in CHAIDE SMART services. Do not disregard or delay seeking medical advice based on CHAIDE SMART content. Exercises/activities described may not suit everyone. Participation carries inherent risks of injury or death. In a medical emergency, contact your doctor or local emergency services immediately. Discontinue any activity causing discomfort. Individuals with type 1 diabetes or other medical/nutritional conditions must not use CHAIDE SMART services without direct medical supervision. Using CHAIDE SMART implies your doctor's approval for your participation.
We are not responsible for health issues arising from training plans, products, or activities accessed via CHAIDE SMART. Engaging in such activities signifies voluntary participation at your own risk.
8.3 Content and Warranty Disclaimer
This website is provided by CHAIDE SMART, and their partners "as is." Neither CHAIDE SMART, nor their affiliates, suppliers, or partners make any express or implied warranties regarding website operation, content, or accuracy. All implied warranties (including merchantability, fitness for purpose, and non-infringement) are disclaimed. CHAIDE SMART do not guarantee uninterrupted, secure, or error-free use, or the absence of viruses or harmful components.
8.4 Limitation of Liability
Under no circumstances shall CHAIDE SMART be liable for any direct, indirect, incidental, punitive, or consequential damages arising out of the use of, inability to use, or results of use of the website (including but not limited to loss of profits, loss of data, or loss due to business interruption), whether such damages are based on warranty, contract, tort, or any other legal theory, and whether CHAIDE SMART have been advised of the possibility of such damages. The partners, suppliers, and collaborators of CHAIDE SMART shall not be liable for any issues arising from the website. The applicable laws in certain regions may not allow some of the above limitations, in which case such limitations may not apply to you.
9 General Provisions
These Terms and Conditions, as well as the relationship between CHAIDE and the User, will be governed and interpreted in accordance with the laws in force in the Republic of Ecuador.
10 Agreement Modifications
Your use of CHAIDE SMART Services shall be deemed that you have read and agreed to be bound by this Terms of Service. We reserve the right to modify the terms of this Agreement when necessary. You may review the relevant agreement terms at any time. After the terms of this Agreement are changed, if you continue to use CHAIDE SMART Services, it shall be deemed that you have accepted the modified Agreement. If you do not accept the modified Agreement, you shall stop using CHAIDE SMART Services.
